Estate of Harrison Johnson, Deceased

Will of Harrison Johnson. Dated 21 Feb. 1862. Filed 31 Aug. 1863. I Give and bequeath to my mother Elizabeth A Johnson all of my property to wit one negro man, name Henry aged about 23 years of Malata Complecteon and my Two horses, one a sorrel colt 2 years old and the other a sorrel mare 4 years old and also my stock of Cattle it being one half Interest in forty head of Cattle own Jointly by myself and H. C. Johnson, marked ____ and branded H. J.... I likewise make constitute and appoint unto Stephen Terry to be my Executor of this my last will and Testament. . . .
Witnesses: G. Nance and C. E. (or C. G.) Payne.
Proved 31 August 1863 by oath of G. Nance. J. D. Parker and William Little, Co. Coms. and acting Chief Justice, Tarrant Co.

Bond of Stephen Terry, Executor; $2000. Sureties: John A. Wims, J. D. Parker and William Little. Co. Com'rs.

Stephen Terry, in District Court, July term 1871, reports that on the 31st day of Decr 1862 at the Battle of Murfreesboro Tennessee that the said H. Johnson was killed in Battle and leaving a will and testament of all his effects ... which will bears date of 21st day of Feb. 1862 therein giving and bequeathing to his mother Elisabeth A. Johnson all his property.... Your reporter would further report that on ... the 31st day of August 1863 ... said will was admitted to probate. .. and afterwards to wit on the [blank] day of 1863 all the liabilities of said decedent were paid off and discharged and further that on to wit the [blank] day of 1863 Mrs. Elisabeth A. Johnson departed this life leaving no will ... disposing of her said Estate leaving all of her said Estate as well as that of her son H. Johnson to be disposed of as the laws should direct and that on to wit [blank] day of 1864 that A. D. Johnson the surviving husband of the said Elisabeth A. Johnson Departed this life he having no will or testamony disposition of his Estate then and ther leaving all the property to a private Distribution between all the heirs when all the personal property of the aforesaid three Estates wer all throne into hatch-patch and prorated between the surviving heirs the Negroes all being set free by the result of the War.... Sworn May 1. 1871. before Dan Parker.
